Crowdsurf Music, Inc. Terms of Service
The agreement that governs your use of the Crowdsurf app, website, and related services.
Welcome to Crowdsurf Music, Inc. (“Crowdsurf,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Crowdsurf mobile application, website, and related services (collectively, the “Service”). By creating an account or using Crowdsurf, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Crowdsurf. If you are under 18, you represent that you have permission from a parent or guardian. We reserve the right to refuse access to anyone for any reason at any time.
The Service is currently offered only in the United States. By using Crowdsurf, you represent that you are accessing the Service from within the United States. If you access the Service from outside the United States, you do so at your own risk and remain responsible for compliance with your local laws.
2. Your account
To use Crowdsurf, you may need to create an account by providing accurate and complete information, including your name, stage name, and email.
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
You may not share your account, impersonate another person, or use the Service for any unlawful or unauthorized purpose. Crowdsurf may suspend or terminate accounts that violate these Terms.
3. Use of the Service
Crowdsurf enables users to share, recommend, and discuss music with friends. You can:
- Share songs and previews through integrated music platforms (e.g., Spotify, Apple Music).
- View and interact with features such as waves, surf scores, and leaderboards.
You agree not to:
- Use the Service for any illegal, harmful, or abusive activity.
- Post spam, scams, or misleading content.
- Interfere with or disrupt the Service’s functionality.
- Attempt to reverse-engineer, scrape, or misuse our API or infrastructure.
We reserve the right to remove content or restrict access to maintain the safety and integrity of the community.
4. Community guidelines
Crowdsurf is built around positive music discovery and community. You agree not to:
- Engage in hate speech, bullying, or harassment.
- Impersonate others or share false information.
- Share explicit, violent, or otherwise inappropriate content.
- Violate any applicable laws or rights of others.
Violation of these standards may result in suspension or permanent removal from the platform.
5. Subscriptions and payments
Some features of Crowdsurf may be available only through a paid subscription (“Crowdsurf Premium”).
- Billing & renewal: subscriptions renew automatically unless canceled at least 24 hours before the renewal date.
- Cancellation: you can cancel anytime via your App Store or Google Play account settings.
- Trials: if offered, free trials will automatically convert to paid subscriptions unless canceled before the trial ends.
- Refunds: all payments are non-refundable except as required by law.
- Pricing changes: we may update pricing with prior notice. Continued use after changes constitutes acceptance.
6. Monetization features
In the future, Crowdsurf may introduce programs that reward users for sharing or generating engagement (“Monetization Features”). Participation in these programs will require additional terms, identity verification, and compliance with tax and legal obligations. Crowdsurf may modify or terminate such programs at any time. Specific contests — such as the Tastemaker Challenge — are governed by their own official rules.
7. Data & security
We use industry-standard security practices (encryption, secure databases, and restricted access) to protect your data. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your login credentials confidential and reporting any unauthorized access immediately. 8. Intellectual property
Crowdsurf and all related technology, branding, design, and content (excluding linked music content) are the property of Crowdsurf Music, Inc. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written consent. All trademarks, service marks, and logos used on the Service belong to Crowdsurf Music, Inc. or their respective owners.
If you believe content on Crowdsurf infringes your copyright, send a written notice to legal@getcrowdsurf.com with the information required by 17 U.S.C. § 512(c)(3) (DMCA takedown notice). We will respond to valid notices in accordance with the Digital Millennium Copyright Act and may terminate the accounts of repeat infringers.
9. Third-party integrations
Crowdsurf connects with external music services (such as Spotify or Apple Music) to enable sharing and playback of song previews. By linking your account, you also agree to the terms and privacy policies of those third-party platforms. Crowdsurf is not responsible for their content, data handling, or service availability.
10. Termination
We may suspend or terminate your account at any time if you violate these Terms, misuse the Service, or engage in harmful behavior. You may delete your account at any time within the app settings. Upon termination, your right to access Crowdsurf will immediately end. Sections 8, 11, 12, 13, 14, and 15 survive any termination.
11. Disclaimers
Crowdsurf is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee continuous, error-free, or secure access to the Service. You use Crowdsurf at your own risk.
12. Limitation of liability
To the maximum extent permitted by law, Crowdsurf Music, Inc. and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the greater of (a) the total amount you paid to use Crowdsurf in the 12 months prior to the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
13. Dispute resolution and arbitration
You agree to resolve any disputes with Crowdsurf through binding individual arbitration rather than in court. All arbitration will be conducted individually under the rules of the American Arbitration Association (AAA), seated in San Francisco, California, with each party bearing its own costs except as the AAA rules provide otherwise. You may bring claims in small-claims court if they qualify.
You waive any right to participate in class actions, class arbitrations, or jury trials. This provision survives the termination of these Terms. If a court finds the class-action waiver unenforceable in your case, the parties’ agreement to arbitrate is void as to that case only.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we’ll notify you by email or in-app notification. Your continued use of Crowdsurf after the updated Terms become effective constitutes your acceptance.
15. Governing law and severability
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any disputes not subject to arbitration will be handled exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Entire agreement
These Terms, together with our Privacy Policy and any contest-specific rules (such as the Tastemaker Challenge official rules), constitute the entire agreement between you and Crowdsurf regarding the Service and supersede any prior agreements on the same subject.
